MARMCJ Journal Publishers – Standard Terms and Conditions
The M Abdur Rahim Medical College Journal (MARMCJ) grants the Licensee the non-exclusive and non-transferable right to provide authorized users with online access to the MARMCJ Journals, including subscribed journals and individual papers purchased by the Licensee (referred to as ‘Licensed Materials’). The access is intended for research, teaching, and private study purposes only. For any permissions beyond this scope, please contact djmcjournal@hotmail.com
Definitions:
Authorized Users: Current faculty, staff, consultants, contractors, registered students, and individuals permitted to use the Licensee’s library services. Access is authenticated by the Licensee, either on the library premises or remotely through designated computer terminals.
Commercial Use: Any use of the Licensed Materials for monetary gain, excluding direct costs incurred by the Licensee.
Course Packs: Collections of materials compiled by Authorized Users for instructional purposes in a class.
Electronic Reserve: Electronic copies of materials stored on the Secure Network for use in specific courses offered by the Licensee.
Secure Network: A restricted network accessible only to Authorized Users with authenticated login credentials, regulated by the Licensee.
The Licensee may:
1. Allow Authorized Users access to the Licensed Materials through the Secure Network.
2. Provide integrated author, article title, abstract, and keyword indexes to the Licensed Materials.
3. Provide single printed or electronic copies of articles upon request from individual Authorized Users.
4. Display, download, or print the Licensed Materials for internal information, marketing, testing, and training purposes.
Include Licensed Materials in printed Course Packs and Electronic Reserve, ensuring appropriate acknowledgments.
Authorized Users may:
1. Search, view, retrieve, and display the Licensed Materials.
2. Electronically save search results, articles, or extracts for personal use.
3. Print search results or single copies of articles or extracts.
4. Distribute single copies of articles or extracts to other Authorized Users.
Neither the Licensee nor any Authorized User may, without prior written consent from MARMCJ:
1. Remove or alter authors’ names or MARMCJ’s copyright notices or other means of identification.
2. Mount or distribute any part of the Licensed Material on any electronic network other than the Secure Network.
3. Use, print, resell, or republish Licensed Materials for any Commercial Use.
4. Systematically or programmatically distribute the Licensed Materials to anyone other than Authorized Users.
5. Publish, distribute, or make available the Licensed Materials, works based on them, or works combining them with other materials.
6. Alter, abridge, adapt, or modify the Licensed Materials beyond the extent necessary for perceptibility on a computer screen.
MARMCJ warrants that the Licensed Materials do not infringe any copyright or proprietary rights. MARMCJ will indemnify the Licensee against legal actions claiming such infringement, except in cases where the Licensee has amended the Licensed Materials beyond this License’s permitted scope.
MARMCJ reserves the right to withdraw any part of the Licensed Materials, which it no longer retains the right to publish or deems infringing, defamatory, obscene, unlawful, or objectionable.
MARMCJ shall not be liable for any damages arising from the inability to use the Licensed Materials or their use. Liability for any claims or losses due to a breach of this License shall not exceed the fee paid by the Licensee under this License for the relevant subscription period.
The Licensee shall ensure that only authorized users access the Licensed Materials and abide by the terms of this License. The Licensee shall inform MARMCJ immediately of any unauthorized use or breach and take appropriate actions to prevent recurrence.
On termination of this License, access to Licensed Materials within the subscription period paid by the Licensee shall continue. Termination may occur due to a material breach by either party.
All rights and obligations under this License automatically terminate upon termination, except for obligations related to continuing access to permitted Licensed Materials.
Any notices between the parties shall be sent to the addresses provided in this License.
This License is governed by the laws of India, and any dispute will be subject to the jurisdiction of the Indian courts, with Mandsaur (MP) as the subject to jurisdiction for any queries or infringements.
